Terms of Use

By using the website or the web study app, or by downloading, opening or buying access in either app, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Pass New York.

Pass New York is independent study material for the New York State real estate salesperson examination. It includes lessons, practice questions, explanations, calculators, a timed simulation, progress tracking and related guides.

Pass New York is not affiliated with, approved by or endorsed by the New York State Department of State. It is not the 77-hour qualifying course that New York requires, and it does not replace that course, the school’s final exam or any official instruction. It does not provide legal, tax, lending, appraisal or other professional advice.

You must be old enough to form a binding contract where you live. If you create an account, keep your sign-in details private and tell us about any unauthorized use. You are responsible for activity on your account.

• The website’s study guide, sample questions, simulation, glossary and calculators are free.
• The app is free to download and includes a free portion.
• The Pass New York web study app (app.passnewyorkrealestate.com) is a browser version of the app that you use while signed in. It uses the same Pass New York account as the phone app and includes a free portion.
• Full access is a single one-time purchase. It is not a subscription and never renews or charges you again. One purchase unlocks full access in the phone app and in the web study app when you sign in with the same Pass New York account.
• In the phone app, full access is an in-app purchase, currently $59.99 in the United States. Apple or Google sells and processes it under its own terms. The price shown in the store at checkout, including any tax and local currency, is the price that applies. You can restore it on another device that uses the same store account, using Restore purchase in the app.
• Web purchases are sold and processed by Paddle (Paddle.com Market Ltd), our authorized reseller and merchant of record. Paddle provides the checkout, collects payment and applicable taxes, issues the receipt, and handles invoicing and billing support. The price shown at Paddle checkout, including any tax and local currency, is the price that applies.
• Payments, refund requests, chargebacks and purchase disputes are handled by the company used for the purchase: Paddle for web purchases, Apple for App Store purchases and Google for Google Play purchases. Each purchase is subject to that company’s buyer terms and refund rules, together with any rights you have under applicable law.
• The purchase gives you a personal, non-transferable, non-exclusive license to use the full app and web study app for your own exam preparation. Refunds are covered by our Refund Policy.

The questions, explanations, lessons, graphics and software in Pass New York belong to us or our licensors. Please do not:

• copy, publish, sell or share our questions or lessons, or use them to build another question bank or course;
• scrape the website or app with automated tools, except ordinary search-engine indexing of public pages;
• share, resell or transfer your access;
• reverse engineer the app, get around access controls or interfere with the service; or
• use Pass New York for anything unlawful or abusive.

You are welcome to link to our public pages and quote short passages with credit and a link.

We check our material against the New York State curriculum, statutes, regulations and official agency guidance, and we correct errors when we find them. You can report an error from any question in the app or through our support page. Laws, fees and procedures change, though, and the Department of State’s current instructions always control.

Our practice questions are written by us. They are not questions from the state examination. We cannot promise that you will pass the exam, get a license or find work, because that depends on your own preparation and on circumstances outside our control.

We update Pass New York regularly and may add, change or remove features and content. A full-access purchase includes the updates we release to the app and the web study app for as long as we publish and support them. The app needs a compatible device and operating system, the web study app needs a supported browser and an internet connection, and some app features, such as sync, need an internet connection.

To the fullest extent the law allows, Pass New York is provided “as is” and “as available,” without warranties of any kind, including warranties that it will be uninterrupted, error free or fit for a particular purpose. Some places do not allow these exclusions, so some of them may not apply to you.

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, lost profits, a failed exam or a licensing delay, arising from your use of Pass New York. Our total liability for any claim is limited to the amount you paid us for Pass New York in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

You can stop using Pass New York and delete your account at any time. We may suspend or end access if you seriously or repeatedly break these terms, commit fraud, or put the service or other people at risk. Sections that by their nature should continue, such as ownership, disclaimers and limitation of liability, survive after access ends.

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules, except where the consumer law of the place you live gives you different rights. Before bringing any claim, please contact us so we can try to resolve it informally.

If you downloaded the app from the Apple App Store, these terms are between you and Pass New York, not Apple. Apple has no obligation to provide maintenance or support for the app, and Apple’s Standard Licensed Application End User License Agreement applies where these terms do not address something. The same principle applies to Google Play. Apple and Google are third-party beneficiaries of these terms and may enforce them.

We may update these terms. The date at the top shows the current version, and we will give notice in the app for material changes. Continuing to use Pass New York after a change means you accept the updated terms. Questions? use Settings, Contact support in the app.
